2. ENTIRE AGREEMENT: The entire Agreement between You and Us is composed of the Application and these Agreement terms and provisions (the "Provisions").
2A. REQUIRED NOTICE TO FLORIDA AGREEMENT PURCHASERS: Motor Vehicle Service Agreements are governed by Chapter 634 of the Florida Insurance Code and are regulated by the Florida Office of Insurance Regulation.
FRAUDULENT CLAIM NOTICE: Under the Code, any person who, with the intent to injure, defraud or deceive any insurer, knowingly files an application for coverage or a statement of claim that contains false, incomplete or misleading information, is guilty of a felony of the third degree.
3. FULL FAITH & CREDIT OF OBLIGOR: As the obligor of this Agreement, We back all of the obligations arising under this Agreement with our full faith and credit.
4. DEFINITIONS: As used in this Agreement, the following terms shall have the following meaning:
A) Branded Vehicle - A vehicle with a valid Certificate of Title denoting that it has a salvage title, or that the vehicle had been stolen at some time, or that the vehicle was "totaled" under any insurance claim.
B) Commercial Business Use - A Vehicle is employed in a Commercial Business Use if: a) it is used primarily for business purposes with multiple drivers; or, b) it is used in a farm, delivery or construction business; or c) it is designated by the Selling Dealer as a vehicle for Commercial Business Use when the sale is reported to the vehicle's manufacturer. For Ford, Lincoln or Mercury vehicles, this would include any vehicle reported sold with a Delivery Code of "7", "D", "E", or "L".
C) Competitive-Make Vehicle - Any brand of vehicle other than Ford, Mercury or Lincoln.
D) CORE Coverages - Motor Vehicle Service Agreement Coverages available under this Agreement with the designated levels of benefits as defined in this Agreement and identified as: PowertrainCARE, BaseCARE, ExtraCARE, and PremiumCARE, including comparable fleet and Limo coverages.
E) Eligible Repair Visit - A single visit to a dealer or other service or repair provider for the service or repair of a covered Vehicle failure or failures.
F) Emergency Service or Repair - Necessary service or repair, required because the Vehicle is inoperable and all local Ford and Lincoln-Mercury dealership service departments are closed.
G) Failures - Cessations of normal functioning arising because of failures in materials or workmanship, or cessations caused by normal wear and tear due to failures in materials or workmanship.
H) New Vehicle Limited Warranty - The original manufacturer's limited warranty covering a new Vehicle or any parts or components of that Vehicle.
I) Replacement Tire - Means a tire of the same brand and model as came with the Vehicle when it was originally equipped by the manufacturer, unless the same brand and model is no longer available. In such a case, "Replacement Tire" means a tire of the same brand, size, load, speed and tread type.
J) Vehicle - The vehicle (or, with regard to Fleet Coverages, group of vehicles) that is (are) the subject of this Agreement and which has (have) been identified by Vehicle Identification Number (the "VIN") in the Application.
K) VIN - The Vehicle Identification Number placed on the vehicle by the manufacturer.
L) Selling Dealer - The authorized Ford, Mercury or Lincoln dealership and Motor Vehicle Service Agreement Agent that sold You this Agreement, or that was affiliated with the sale of this Agreement.
M) Signature Date - The date You entered into this Agreement and signed the Application.
N) Warranty Start Date ("WSD") - The date on which the New Vehicle Limited Warranty for the Vehicle took effect, which is the date the Vehicle was first placed in service (the "In-Service" Date). If the Vehicle was a dealership demonstrator unit, the Vehicle's In-Service Date is the date the Vehicle was placed into demonstrator service.
O) Zero Miles - The starting mileage for the calculation of the expiration of all New Vehicle Limited Warranties. For benefit determinations, all New Vehicle Limited Warranties are deemed to begin at zero mileage on the Vehicle.
5. DEDUCTIBLES, STANDARD & OPTIONAL
If You have elected a coverage with a deductible, either the Standard Deductible or the Optional Deductible that You have purchased, will apply for each Eligible Repair Visit. An Eligible Repair Visit occurs each time a covered Vehicle failure (or failures) is repaired by a dealer or other provider on a single visit.
5A. NEW PLAN - DEDUCTIBLES
NEW PLAN - CORE COVERAGES (Fleet and non-Fleet): The Standard Deductible under this Agreement for New Plan Core Coverages is fifty dollars ($50) per Eligible Repair Visit, irrespective of the number of failures to be repaired at any one time. You will be charged either the Standard Deductible or the Optional Deductible you have elected. Various Optional Deductibles for New Plan Core Coverages are available:
a) a $0 Deductible;
b) a $100 Deductible;
c) a $200 Deductible (which is available only on plans for mileage durations of 75,000 or 100,000 miles Not available for Certified Pre-Owned Vehicle Upgrade Coverages); and
d) a Disappearing Deductible (Not available under New Plans for competitive-make vehicles).
NEW PLAN - F650/750 COVERAGES and LIMO COVERAGES: The Standard Deductible under this Agreement for New Plan F650/750, and Limo Coverages is fifty dollars ($50) per Eligible Repair Visit, irrespective of the number of failures to be repaired at any one time. You will be charged the Standard Deductible for each Eligible Repair Visit.
NEW PLAN RentalCARE COVERAGES and ALTERNATIVE FUEL (COMPRESSED NATURAL GAS/LIQUID PROPANE GAS) COVERAGE: There are no deductibles under any of these coverages.
5B. USED PLAN - DEDUCTIBLES
USED PLAN - CORE COVERAGES (non-Fleet only): The Standard Deductible under this Agreement for Used Plans is one hundred dollars ($100) per Eligible Repair Visit, irrespective of the number of failures to be repaired at any one time.You will be charged either the Standard Deductible or the Optional Deductible you have elected. Various Optional Deductibles for Used Vehicle Plans are available. These include:
a) a $50 Deductible;
b) a $200 Deductible; and
c) a Disappearing Deductible.
USED PLAN ELECTRIC VEHICLECARE COVERAGES: The Standard Deductible under this Agreement for Used Plan Electric VehicleCARE Coverages is one hundred dollars ($100) per Eligible Repair Visit, irrespective of the number of failures to be repaired at any one time. You will be charged the Standard Deductible for each Eligible Repair Visit.
USED PLAN - FORD OR MOTORCRAFT REMANUFACTURED GASOLINE ENGINE COVERAGES: The Standard Deductible under this Agreement for Used Plan Ford or Motorcraft Remanufactured Gasoline Engine Coverages is fifty dollars ($50) per Eligible Repair Visit, irrespective of the number of failures to be repaired at any one time. You will be charged the Standard Deductible for each Eligible Repair Visit.
USED PLAN - FORD OR MOTORCRAFT REMANUFACTURED TRANSMISSION COVERAGES: The Standard Deductible under this Agreement for Used Plan Ford or Motorcraft Remanufactured Transmission Coverages is fifty dollars ($50) per Eligible Repair Visit, irrespective of the number of failures to be repaired at any one time. You will be charged the Standard Deductible for each Eligible Repair Visit.
5C. DISAPPEARING DEDUCTIBLE - This benefit is available only for the following coverages:
NEW PLAN - CORE Coverages - Fleet and non-Fleet (but Excluding Competitive-Make vehicles), and,
USED PLAN - CORE Coverages (Including Competitive-Make vehicles):
The Disappearing Deductible is only available in conjunction with the Standard Deductible and is not available with any Optional Deductibles. When the Disappearing Deductible is elected, there will be no deductible charged for each Eligible Repair Visit where services are performed by the Selling Dealer. NOTE: The Disappearing Deductible does not apply when repairs are performed at a dealership or repair facility other than the Selling Dealer.
6. WHAT THIS AGREEMENT COVERS: Subject to the deductibles, exclusions and other limitations in this Agreement, and depending on the Plan(s) and Coverage(s) that You have elected, service and repairs (including the costs of both parts and labor) will be provided as shown below. During the term of this Agreement, We agree that the Selling Dealer, another franchised dealer, or We, will either: (a) service your Vehicle; (b) repair or replace covered failures; or, (c) reimburse You for the Vehicle's servicing, or for the repair or replacement of covered failures.
NOTE: Repairs or teardowns performed at facilities other than Ford, Lincoln or Mercury dealers are not covered unless they are Emergency Services or Repairs as defined in this Agreement.
NOTE: We reserve the rights to: (a) inspect the Vehicle before performing any service or repairs; and (b) to inspect any parts that are serviced, repaired or replaced.
6A. COVERED ITEMS - "PowertrainCARE"
NEW PLAN - CORE Coverages - Ford and Competitive Make, including Fleet (but excluding Fleet Maintenance & Wear Benefits) ; F650/750 Coverages; and,
USED PLAN - CORE Coverages:
If You elected PowertrainCARE, the following items are covered:
Engine - Cylinder block and all internal lubricated parts, seals and gaskets, the cylinder heads, manifold (exhaust), manifold (intake), factory installed turbocharger/supercharger units, timing chain (gears or belt), flywheel, valve covers, oil pan, timing chain cover, oil pump, water pump, thermostat, thermostat housing. (EXCEPTIONS: CARBURETION AND FUEL INJECTION COMPONENTS ARE NOT COVERED).
Transmission - Transmission case and all internal parts including torque converter and transfer case (all internal parts), seals and gaskets.
Front-Wheel Drive - Final drive housing and all internal parts, universal and constant velocity joints, front-wheel bearings, axleshafts, locking rings (four-wheel drive vehicles), seals and gaskets, automatic front locking hubs (four-wheel drive), rear wheel bearings.
Rear-Wheel Drive - Drive axle housings and all internal parts, universal and constant velocity joints, rear-wheel bearings and retainers, axle shafts, seals and gaskets, driveshafts, front wheel bearings.
F650/750 Vehicles - All model year 2000 and later vehicles are eligible for F650/750 Coverage, except for the following: Emergency vehicles, tow truck/vehicle carrier, branded or repossessed vehicles, vehicles used in daily rental and vehicles that are outside the original New Vehicle Limited Warranty, which is 24 months from the Warranty Start Date as verified on the Selling Dealer's "Online Automotive Service Information System" ("OASIS").
Vehicles With Snow Plows - ONLY the following NEW vehicles, when equipped with snow plows, are eligible for coverage: new Ford, Lincoln or Mercury vehicles purchased with a Snow Plow Prep Package 53C, 86M or 627 (770 Payload Group-V8) for service contract plans (with or without Maintenance and Wear coverage) and with a duration of less than 100,000 miles. NOTE: No USED vehicles with snowplows are eligible for coverage.
Incomplete Vehicles - The following vehicles are ONLY eligible for the ESP New Plan PowertrainCARE coverages with a $50 deductible: Incomplete Ford vehicles with the first three VIN positions of 1FC, 1FD (except body types E14, E24 or S24), 2FC, 2FD, 3FC, 3FD and 3FE.
6B. COVERED ITEMS - "BaseCARE"
NEW PLAN - CORE Coverages - Ford and Competitive Make, including Fleet (but excluding Fleet Maintenance & Wear Benefits); F650/750 Coverages; and,
USED PLAN - Including all CORE Coverages:
If you have elected BaseCARE, the following items are covered in addition to the items covered above under PowertrainCARE:
Odometer & Speedometer - Coverage is provided for both the odometer and speedometer, including all cables and connectors.
Engine - Gas fuel injectors and lines, harmonic balancer and bolt, diesel injector pump. For F650/750 Vehicles Only: diesel injectors.
Transmission - Governor Assembly.
Steering - Power steering pump, cooler and lines, couplings, seals and gaskets, manual and power steering gear housing and all internal parts, including linkages, control valve, column lock (tilt wheel), pulley assembly for power steering pump, and the idler arm.
Suspension - MacPherson struts (front or rear), upper and lower control arms, stabilizer bar, linkage and bushings, tie rods, control arm shafts and bushings, upper and lower ball joints, kingpins and bushings, spindle and spindle supports. Under the F650/750 Coverages, the following items are also covered: front axle I-beam. NOTE: This coverage includes only the items listed in this paragraph and does not include either front end alignments or wheel balancing, unless the repair to such items is required in conjunction with the repair of a covered failure.
Brakes - Master cylinder, calipers and wheel cylinders, combination valve, all lines and fittings, power brake booster, backing plates, springs, clips and retainers, self adjusters, parking brake linkage and cables, brake pedal shaft. Under the F650/750 Coverages, the following items are also covered: brake chambers, air brake compressor, air brake foot valve, air brake quick release valve, air brake modulator relay valve, air brake parking break dash valve. NOTE: This coverage includes only the items listed in this paragraph and does not include brake drums, rotors, linings or pads, unless the repair to such items is required in conjunction with the repair of a covered failure.
Air Conditioning - Compressor, condenser, evaporator, A/C compressor head, A/C compressor clutch switch, A/C clutch and clutch bearings, compressor seals, pulley and field coil. If your A/C system has R-12 refrigerant, R-12 will be used for replacement while supplies last. If R-12 refrigerant is no longer available, the Vehicle's a/c system will be converted to use R-134a refrigerant to meet environmental standards. If the replacement is due to the failure of a covered part, we will make the repair at our cost. If the replacement is due to the failure of a non-covered part, you will be responsible for any additional cost.
Electrical - Alternator, starter motor, voltage regulator, manually operated electrical switches, ignition switch, wiper motors, electronic ignition module, radiator fan relay, fuel pump, starter motor solenoid, wiring harnesses (excluding spark plug wires), and electrical components of a heated backglass. NOTE: Heated backglass coverage is for electrical components only and does not include general glass damage or breakage.
F650/750 Vehicles - All model year 2000 and later vehicles are eligible for F650/750 Coverage, except for the following: Emergency vehicles, tow truck/vehicle carrier, branded or repossessed vehicles, vehicles used in daily rental and vehicles that are outside the original New Vehicle Limited Warranty, which is 24 months from the Warranty Start Date as verified on the Selling Dealer's "Online Automotive Service Information System" ("OASIS").
Vehicles With Snow Plows - ONLY the following NEW vehicles, when equipped with snow plows, are eligible for coverage: new Ford, Lincoln or Mercury vehicles purchased with a Snow Plow Prep Package 53C, 86M or 627 (770 Payload Group-V8) for service contract plans (with or without Maintenance and Wear coverage) and with a duration of less than 100,000 miles. 6C. COVERED ITEMS - "ExtraCARE"
NEW PLAN - CORE Coverages - Ford and Competitive Make, including Fleet; and Limo Coverages; and,
USED PLAN - CORE Coverages:
If you have elected ExtraCARE, the following items are covered in addition to the items covered above under the PowertrainCARE and BaseCARE:
Engine - Flywheel ring gear, diesel lift pump and diesel injectors.
Electrical - Distributor assembly.
High Tech - Air conditioner accumulator, ETA pump hose assembly, anti-lock brake module and sensor, automatic temperature control, compass and thermometer read-out displays, distributor housing and shaft, distributor cap and rotor, electronic air suspension (selected components), electronic instrument cluster (excluding the dash pad, clock, audio and visual equipment), fuel tank and lines, diesel injectors and lines, heater blower motor and core assembly, electrical components of an Insta-ClearŪ? windshield (NOTE: this coverage is for the electrical components only and does not include general glass damage or breakage), keyless entry system (excluding door handles), power seat motors, power window motors and regulators, power antenna, power door locks (excluding door handles and electronic key fobs), power door lock retainer clip, radiator, radiator fan, radiator fan clutch or motor, speed control, engine mounts, transmission vacuum module and mounts, external transmission module.
6D. COVERED ITEMS - "PremiumCARE"
NEW PLAN - CORE Coverages - Ford and Competitive Make, including Fleet; and,
USED PLAN - CORE Coverages:
If You have elected PremiumCARE, all failures are covered EXCEPT for those items specifically excluded below in the Provision entitled: "WHAT IS NOT COVERED BY THIS AGREEMENT".
6G. COVERED ITEMS - NEW PLAN "RentalCARE Coverages" - If you have elected RentalCARE coverage it applies only after the servicing facility determines that the following eligibility requirements have been met:
1) the service or repair is covered under the New Vehicle Limited Warranty; or,
2) the service or repair is the result of a manufacturer's recall or other Customer Satisfaction program.
Reimbursement will be made for vehicle rental charges incurred, up to a maximum of twenty eight dollars ($28) per day for Ford and Mercury vehicles (thirty five dollars ($35) per day for Lincoln vehicles), limited to a maximum duration of three (3) days while the repair is being completed. Provided that the eligibility requirements have been met, coverage begins when the Vehicle is delivered to the selling dealer or other franchised dealer for service. Each eligible day is defined as the next ensuing twenty-four (24) hour period thereafter. The rental vehicle must be rented from a Ford or Lincoln-Mercury dealership or other commercial agency to be eligible for reimbursement.
6H. COVERED ITEMS - USED PLAN - "FORD OR MOTORCRAFT REMANUFACTURED GASOLINE ENGINE COVERAGES" - If You elected Ford or Motorcraft Remanufactured Gasoline Engine Coverages, the following items are covered:
All Engines: Cylinder block, crankshaft, cylinder heads, camshaft, timing gear, oil pump, internal seals and gaskets, and all internal lubricated parts (including pistons, rings, bearings, etc.) Additionally, the following items are covered if the remanufactured engine was so equipped at the time of purchase: oil cooler, oil pan, water pump, valve covers, front cover, front seal, crank damper, oil adaptor, and heater tube. EXCEPTIONS: CARBURETION AND FUEL INJECTION COMPONENTS ARE NOT COVERED.
All model year 1988 and later Ford, Mercury and Lincoln vehicles are eligible for Ford or Motorcraft Remanufactured Gasoline Engine Coverage, except for the following: Any Mustang Cobra R, Saleen and Roush modified vehicles, Branded vehicles, electric vehicles, any vehicles equipped with snow plows that are not specifically included in the Provision entitled "Covered Items - PowertrainCARE" as contained in this Agreement, and any incomplete Ford vehicles with the first three VIN positions of 1FC, 1FD (except body types E14, E24 or S24), 2FC, 2FD, 3FC, 3FD and 3FE.
6I. COVERED ITEMS - USED PLAN - "FORD OR MOTORCRAFT REMANUFACTURED TRANSMISSION COVERAGES" - If You elected Ford or Motorcraft Remanufactured Transmission Coverages, the following items are covered:
All Transmissions: The Transmission case and all internal parts including the torque converter and seals and gaskets.
All model year 1988 and later Ford, Mercury and Lincoln vehicles are eligible for Ford or Motorcraft Remanufactured Transmission Coverage, except for the following: Mustang Cobra R, Saleen and Roush modified vehicles, Branded vehicles, electric vehicles, any vehicles equipped with snow plows that are not specifically included in the Provision entitled "Covered Items - PowertrainCARE" as contained in this Agreement, and any incomplete Ford vehicles with the first three VIN positions of 1FC, 1FD (except body types E14, E24 or S24), 2FC, 2FD, 3FC, 3FD and 3FE.
6J. COVERED ITEMS - USED PLAN - Electric VehicleCARE Coverages
If You have elected Electric VehicleCARE Coverages, all Vehicle failures, including those unique to electric vehicle usage and operation, are covered EXCEPT for those items specifically excluded below in the Provision entitled: "WHAT IS NOT COVERED BY THIS AGREEMENT".
NOTE: If you have elected Electric VehicleCARE Coverage, the following electric vehicle items are specifically included under this coverage: Traction inverter module (TIM), hi-voltage charger, power steering unit, contactor box, motor/transaxle, battery control module (BCM), DC to DC converter, A/C - IMC, PTC module, A/C compressor, PTC heater core, heater blower assembly - EV unique, charge inlet, IO Module, interface adapter assembly (IAA), coolant pump, internal battery cooling, E-drive wiring harnesses.
6K. COVERED ITEMS - NEW PLAN - Alternative Fuel (Compressed Natural Gas / Liquid Propane Gas) Vehicle Coverages
If You have elected Alternative Fuel (Compressed Natural Gas / Liquid Propane Gas) Coverages, failures related to the below listed alternative fuel systems components are covered, but no other mechanical or operational failures are covered.
NOTE: If you have elected Alternative Fuel (Compressed Natural Gas/ Liquid Propane Gas) Coverages, the following alternative fuel items are specifically included under that coverage: All components unique to Compressed Natural Gas or Liquid Propane Gas fuel systems, including: harnesses, injectors, tubes, hoses, fittings, valves, tanks, regulators, fuel lines and rails, modules, connectors, gaskets, and washers.
6L. COVERED ITEMS - NEW PLAN - Limo Coverages
If You have elected Limo Coverages, You will receive all of the benefits provided to a New Plan ExtraCARE Core Coverage purchaser, other than Rental Transportation Assistance.
7. ADDITIONAL BENEFITS
7A. ROADSIDE ASSISTANCE COVERAGE - Available with the following coverages only:
NEW PLAN: ALL CORE COVERAGES (Fleet or non-Fleet); F650/750 Coverages; Limo Plan Coverages and
USED PLAN: ALL CORE COVERAGES and ELECTRIC VEHICLECARE COVERAGES.
Roadside Assistance Coverage is being provided as an incidental coverage in this Agreement. Your Roadside Assistance Coverage consists of the following three (3) benefits: i) Roadside Assistance, ii) Emergency Travel Expense Reimbursement, and iii) Destination Assistance, as they are described below:
a) ROADSIDE ASSISTANCE - The Roadside Assistance benefits provided under this Agreement are available to You twenty-four (24) hours a day, seven (7) days a week, and are administered by the Ford Auto Club, Inc. ("Ford Auto Club"), whose address is P.O. Box 224688, Dallas, Texas 75222-4688. For either customer service inquiries or to request roadside assistance, please contact the Ford Auto Club at 800-241-3673. When you call for service, please be prepared to give the information noted below. You will be connected with the Dispatch Center while You are on the line and a service vehicle will be sent to your location to provide service.
WHEN CALLING FOR SERVICE, PLEASE BE PREPARED TO PROVIDE THE FOLLOWING INFORMATION:
1) your name and address or the Vehicle's "VIN" (vehicle identification number);
2) the Vehicle's exact location; and,
3) the nature of your emergency (for example: "You need a tow"; "the Vehicle will not start"; "You are out of gas").
LIMIT OF LIABILITY: We will cover service, up to $100 in benefits, for the Vehicle. If You prefer to arrange your own roadside assistance or towing, We will reimburse the emergency expenses You incur up to a maximum of $100 per disablement.
TO RECEIVE REIMBURSEMENT UNDER THE ROADSIDE ASSISTANCE COVERAGE: To obtain reimbursement, You must send a written statement of your loss and a request for benefits, together with the original receipts for your expenses, to Ford Auto Club at the address shown above within twenty (20) days of the disablement.
ITEMS COVERED: For the Vehicle, Roadside Assistance provides coverage (up to one hundred dollars ($100) in benefits) for the following items (including the cost of the service call and labor costs for services performed at the site of the disablement):
1) Lock-Out Assistance,
2) Flat Tire Changes,
3) Battery Jump Starts (Electric Powered Vehicles' main power cell batteries are not included), limited to not more than three (3) "no charge" service calls during any twelve (12) month period,
4) Out of Fuel Assistance - the delivery of gasoline or diesel fuel to you, including the cost of up to two (2) gallons of gasoline or diesel fuel (5 gallons for E & F series 350 - 750 Trucks), limited to not more than three (3) "no charge" service calls during any twelve (12) month period; and,
5) Towing - when the Vehicle is disabled, limited to one tow per disablement.
ITEMS NOT COVERED: Roadside Assistance does not provide coverage for the following:
1) Replacement parts, gasoline or diesel fuel (except on a covered "out of fuel" call), tire repair, rental of towing equipment, storage fees or any labor performed at a garage or service facility; or, any "out of fuel" service coverage, if at the time the service call is made, the Vehicle is located at either your residence or an operating commercial fueling station;
2) any form of impound towing, or towing by other than a licensed service station or garage, or for the assistance of any private parties.
3) Alternative Fuels (such as Compressed Natural Gas or Liquid Propane Gas).
NOTE: Roadside Assistance service providers are independent contractors and are not employees, agents or representatives of either Ford Auto Club or Us.
b) EMERGENCY TRAVEL EXPENSE REIMBURSEMENT - If the Vehicle is disabled because of either a collision, or a mechanical failure covered by this Agreement or a New Vehicle Limited Warranty, and occurs one hundred (100) miles or more from your residence as shown in Ford Auto Club's records prior to the disablement, We will reimburse You for up to five hundred dollars ($500) of the emergency expenses You incurred within the first seventy-two (72) hours following that disablement, including: meals, lodging, car rental and commercial transportation to your destination (and return after repair) within the vicinity of the disablement.
c) DESTINATION ASSISTANCE - If the Vehicle is disabled because of either a collision, or a mechanical failure covered by this Agreement or a New Vehicle Limited Warranty, and You require Emergency Transportation to your immediate destination, We will reimburse your Emergency Transportation costs up to seventy-five dollars ($75). Emergency Transportation includes taxicabs, shuttles, rental cars, etc.
TO RECEIVE REIMBURSEMENT UNDER EITHER THE "EMERGENCY TRAVEL EXPENSE REIMBURSEMENT" COVERAGE OR THE "DESTINATION ASSISTANCE" COVERAGE: To obtain reimbursement, You must send a written statement of your loss and a request for benefits, together with:
1) the original receipts for your expenses; and,
2) if the disablement is due to a collision, a copy of the accident report filed with the state or local police; or,
3) if the disablement is due to a covered failure, a copy of the repair order indicating the service or repairs performed under this Agreement or the Vehicle's New Vehicle Limited Warranty,
to Ford Auto Club at the address shown above within twenty (20) days of the disablement.
7B. ROAD HAZARD TIRE COVERAGE - Available with the following coverages (only for Ford, Mercury or Lincoln Vehicles that have New Vehicle Limited Warranty remaining at the time of this Agreement's Purchase, if such Warranty covers Tires):

NOTE: THE DURATION OF YOUR ROAD HAZARD TIRE COVERAGE WILL ALWAYS BE THE SAME AS THE DURATION OF YOUR NEW PLAN CORE COVERAGE.
If the Vehicle is covered by a Ford Motor Company New Vehicle Limited Warranty that includes coverage of tire defects, it is also eligible for Road Hazard Tire Coverage under this Agreement on an incidental basis. Road Hazard Tire Coverage is an optional coverage that You may elect. The New Vehicle Limited Warranty does not cover tire failures resulting from road hazards. These occur when a tire fails as a result of a puncture, bruise or break incurred during the course of normal driving on a marked or maintained road. Examples of typical road hazards may include potholes in the roadway, nails, glass, or jagged metal on the roadway.
ELIGIBILITY: Road Hazard Tire Coverage is available for tires originally installed by Ford Motor Company on cars and light trucks (up to and including F-550), if the Vehicle was initially covered by a Ford Motor Company New Vehicle Limited Warranty that includes coverage of tire defects. When the tread is worn below 3/32nds of an inch, the tire is considered worn out and is not eligible for any further benefits under this Agreement. Provided that the Original Equipment tire was not worn out at the time of its replacement, Road Hazard Tire Coverage also applies to any Replacement Tire installed on the Vehicle by the Selling Dealer, or any other franchised dealer or, in an emergency, other repair facility. "Replacement Tire" means a tire of the same brand and model as came with the Vehicle when it was originally equipped by the manufacturer, unless the same brand and model is no longer available. In such a case, "Replacement Tire" means a tire of the same brand, size, load, speed and tread type. In some circumstances, We may authorize another brand and/or model to substitute for the original brand and model, even if the original is still available.
NOTE: For any covered tire, this coverage expires when the tire is worn out.
DEDUCTIBLES: This coverage is not subject to any deductibles.
TIRE REPAIR BENEFIT: If an eligible tire (with at least 3/32nds of an inch of tread remaining) fails as a result of a road hazard during the term of this coverage and can be safely repaired (as determined by an authorized Ford or Lincoln Mercury dealership or, in an emergency, any other repair facility), We will repair the tire or reimburse You for its repair. The maximum repair benefit per tire is limited to $15 per occurrence.
TIRE REPLACEMENT BENEFIT: If an eligible Original Equipment Tire (with at least 3/32nds of an inch of tread remaining) fails due to a road hazard during the term of this coverage and cannot be repaired (as determined by an authorized Ford or Lincoln Mercury dealership or, in an emergency, any other repair facility), We will reimburse You for the unserviceable tire or replace the unserviceable tire with a Replacement Tire. "Replacement Tire" means a tire of the same brand and model as came with the Vehicle when it was originally equipped by the manufacturer, unless the same brand and model is no longer available. In such a case, "Replacement Tire" means a tire of the same brand, size, load, speed and tread type. In some circumstances, We may authorize another brand and/or model to substitute for the original brand and model, even if the original is still available.
This benefit provides for a prorated tire replacement in accordance with the schedule below. The maximum replacement benefit per tire is limited to $150 per occurrence including all taxes and fees (such as mounting fees, balancing fees, tire deposal fees or any other miscellaneous charges).

7C. TOWING REIMBURSEMENT: This benefit is available only with the following coverages:

If a covered failure occurs, or covered services are required, and towing becomes necessary, towing costs will be covered up to one hundred dollars ($100) per incident, for towing to the Selling Dealer or other franchised dealer.
NEW PLAN - Alternative Fuel (Compressed Natural Gas / Liquid Propane Gas ) Coverages:
If a covered failure occurs or covered services are required, and towing becomes necessary, towing costs will be covered up to fifty dollars ($50) per incident, to the Selling Dealer or other franchised dealer.
USED PLAN - CORE Coverages; and Electric VehicleCARE Coverages:
If a covered failure occurs, or covered services are required, and towing becomes necessary, towing costs will be covered up to one hundred dollars ($100) per incident, for towing to the Selling Dealer or other franchised dealer.
NOTE: All towing reimbursement benefits provided under this Agreement, other than for the Alternative Fuel Coverages, are administered by Ford Auto Club.
7D. RENTAL TRANSPORTATION ASSISTANCE: This benefit is available only for the following coverages:
NEW PLAN - CORE Coverages - Fleet and non-Fleet (Including Competitive-Make vehicles); and,
USED PLAN - CORE Coverages (Including Competitive-Make vehicles); and Electric VehicleCARE Coverages:
Rental transportation assistance applies only after the servicing or repairing facility determines that the following eligibility requirements have been met:
a) the service or repair is covered under either this Agreement or a New Vehicle Limited Warranty; or,
b) the service or repair is the result of a Ford Motor Company manufacturer's recall or other Customer Satisfaction program, involving a service or repair that would otherwise be covered by this Agreement; and, in either of these situations,
c) the covered vehicle must be kept overnight by the repairing facility: i) because it was determined to be inoperable at the time it was left for service, or ii) because it was determined that further operation of the Vehicle would damage it so as to render it inoperable. However, if You have purchased the First Day Rental Option, overnight retention by the repairing or servicing facility is not required.
Reimbursement will be made for vehicle rental charges incurred, up to a maximum of twenty eight dollars ($28) per day for Ford, Mercury and all Competitive-Make vehicles (thirty five dollars ($35) per day for Lincoln vehicles), limited to a maximum duration of ten (10) days while the repair is being completed. Provided that the eligibility requirements have been met, Rental Transportation Assistance begins when the Vehicle is delivered to the Selling Dealer or other franchised dealer for service. Each eligible day is defined as the next ensuing twenty-four (24) hour period thereafter. The rental vehicle must be rented from a Ford or Lincoln-Mercury dealership or other commercial agency to be eligible for reimbursement.
7E. FIRST DAY RENTAL OPTION (INCLUDING TRANSPORTATION DROP-OFF FOR FLEETS): This option is available only for the following coverages:
NEW PLAN - all CORE Coverages - Fleet and non-Fleet (but excluding Competitive-Make vehicles):
If your coverages allow for the First Day Rental Option (including Transportation Drop-Off for fleets), and You have elected this option, then this Agreement provides Rental Transportation Assistance for repairs or services made under any of the circumstances listed in the Provision above, even when Your vehicle does not have to be kept overnight for the repair or services to be made. Under this option, the Rental Transportation Assistance begins when You deliver the Vehicle to the Selling Dealer, or other franchised dealer, or other repairing or servicing facility for service. Each eligible day is defined as the next ensuing twenty-four (24) hour period thereafter.
8. WHAT IS NOT COVERED BY THIS AGREEMENT -
NEW PLAN - CORE Coverages, (including all Fleet Coverages), F650/750 Coverages; Alternative Fuel (Compressed Natural Gas / Liquid Propane Gas) Coverages; Limo Coverages; and,
USED PLAN - Including all CORE Coverages; Electric VehicleCARE Coverages; Ford or Motorcraft Remanufactured Gasoline Engine Coverages; and Ford or Motorcraft Remanufactured Transmission Coverages:
A) ALL ITEMS NOT SPECIFICALLY LISTED IN THE COVERED ITEMS LIST ABOVE.
B) Repairs covered by any warranty or manufacturer recalls.
C) Service adjustments and cleaning except in conjunction with a covered repair, unless You have purchased the Fleet Coverage with Maintenance & Wear (fleets only).
D) REPAIRS NEEDED TO ANY ENGINE, TRANSMISSION AND FINAL DRIVE COMPONENTS CAUSED BY AN AFTER-MARKET-INSTALLED TURBOCHARGER OR SUPERCHARGER.
E) Repairs caused by loss of lubricant or fluids or contamination of oil, fluids or fuel.
F) Repairs caused by collisions or other physical damage accidents, unreasonable use (including driving over curbs, overloading, or using the Vehicle as a stationary power source), damage from fire or explosions, road hazards (NOTE: damage to tires caused by road hazards is covered only You have purchased Road Hazard Tire Coverage), other casualty losses, or losses due to negligence, racing or failures caused by either: i) alterations or modifications of the Vehicle, including the body, chassis, or components, after the Vehicle leaves the control of the manufacturer; ii) tampering with the Vehicle, tampering with the emissions systems or with the other parts that affect these systems (as for example, but not limited to: exhaust and intake systems); or, iii) the installation or use of any part not approved by, or authorized by, the Vehicle's manufacturer (other than "certified" emission parts), or any part designated for "off-road use only" installed after the Vehicle leaves the manufacturer's control. Examples of such parts include, but are not limited to: lift kits, oversized tires, roll bars, cellular phones, alarm systems, automatic starting systems and performance-enhancing powertrain components.
G) Damage from the environment (airborne fallout, chemicals, tree sap, salt, hail, windstorm, lightning, freezing, etc.) or from floods, or damage caused by theft, vandalism, riot or acts of war.
H) Repairs resulting from the lack of required or recommended maintenance.
I) Any MANUFACTURER'S RECOMMENDED SCHEDULED MAINTENANCE SERVICES.
J) Repairs to the vehicle if the odometer is altered, broken, repaired or replaced such that actual mileage cannot be determined.
K) Loss of use of the Vehicle, loss of time, inconvenience, commercial loss, consequential damages, and personal expenses such as motels, food, gas and mileage (other than is provided under the Roadside Assistance benefit). NOTE: Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to You.
L) Neither Rental Transportation Assistance , First Day Rental Coverage nor RentalCARE Coverage cover mileage charges, drop-off fees, insurance, gasoline, or state or local taxes.
M) Vehicles manufactured for sale outside of the 50 states of the United States, the District of Columbia, or Canada.
N) Repairs to the Vehicle performed outside of the 50 states of the United States, the District of Columbia, Guam, Puerto Rico or Canada; or repairs required because of normal operation outside of the 50 states of the United States, the District of Columbia or Canada.
O) Under a Used Plan, repairs made to the Vehicle that are required due to a condition that existed prior to the purchase of the Vehicle and would have been obvious during a presale inspection.
P) Shop supplies and environmental waste disposal.
Q) Vehicles are excluded from coverage, if on the Signature Date (or this Agreement is automatically terminated, if at any time during the term of this Agreement), the New Vehicle Limited Warranty of the Vehicle, or any of its specific component parts, is voided, in whole or in part, or the Vehicle is Branded, stolen or salvaged, or if the VIN cannot be established.
R) The following vehicles are excluded from coverage under this Agreement: Any Taxi, livery, emergency or tow vehicles, shuttle or commuter vehicle (unless You have purchased a Limo Coverage, Ford or Motorcraft Remanufactured Gasoline Engine Coverage, or Ford or Motorcraft Remanufactured Transmission Coverage). The following vehicles are excluded from all coverages under this Agreement: Acura NSX models, any Aston Martin, Audi V8 4x4s, any Bentley, BMW Z8s, Cadillac XLRs or any Cadillac model with a 4.1 liter engine; any Daewoo vehicle; all Dodge Stealth or Viper models; any Ferrari, Honda Insight models; all Hummer vehicles, any Jaguar other than "S" or "X" models, any Lotus, all Mitsubishi 3000 Series vehicles, Mustang Cobra R models, all Porsche or Rolls Royce models; all Roush modified vehicles or Saleen modified vehicles, Toyota Prius models or any other "hybrid" vehicle, Branded vehicles, electric vehicles (unless You have purchased an Electric VehicleCARE Coverage), compressed natural gas or propane fuel system components (unless You have purchased an Alternative Fuels "CNG / LPG" Coverage), and any vehicles equipped with snow plows that are not specifically included in the Provision entitled "Covered Items" above, or for which no snow plow use coverage has been purchased.
S) Incomplete Competitive-make vehicles are not eligible for any Plan or Coverage.
T) MAINTENANCE & WEAR ITEMS - The following items are not covered: belts and hoses, brake pads and linings, manual clutch disc, shock absorbers, spark plugs and spark plug wires, and wiper blades. The following items are excluded from all coverages under this Agreement: battery and cables, brakes (front hub, drums, shoes, disc rotors), coolant, exhaust systems, catalytic converters, filters, fluids, lubricants, lights (bulbs, sealed beam, lenses), squeaks and rattles, tires, tune-ups, wheel balancing, wheel alignment, and wheel studs.
U) EXTERIOR SEAL & TRIM ITEMS - Service adjustments for glass and/or body parts, bumpers, door handles, glass, molding, outside ornamentation, paint, rust, sheet metal, structural underbody framework, side-view mirrors (glass or housing), water leaks, wind noise, weatherstrips, wheel covers, ornaments, convertible top, fabric, liners, zippers and fasteners.
V) INTERIOR TRIM ITEMS - Buttons, carpets, dash pad, door and window handles, knobs, rear-view mirror (glass or housing), trim, upholstery.
W) UNDER F650/750 COVERAGES, in addition to the items excluded above, the following are not covered: Emergency vehicles, tow truck/ vehicle carrier, branded or repossessed vehicles, and vehicles used in daily rental.
X) UNDER FORD OR MOTORCRAFT REMANUFACTURED GASOLINE ENGINE COVERAGES, in addition to the items excluded above, the following are not covered: Diesel powered engines, carburetion or fuel injection components, flywheels, manifold and manifold gaskets, engine mounts, pulleys, and engines used in any Mustang Cobra R, Roush modified vehicles, Saleen modified vehicles, Branded vehicles, electric vehicles, compressed natural gas or propane fuel vehicles, any vehicles equipped with snow plows that are not specifically included in the Provision entitled "Covered Items - PowertrainCARE" as contained in this Agreement, and any incomplete Ford vehicles with the first three VIN positions of 1FC, 1FD (except body types E14, E24 or S24), 2FC, 2FD, 3FC, 3FD and 3FE.
Y) UNDER FORD OR MOTORCRAFT REMANUFACTURED TRANSMISSION COVERAGES, in addition to the items excluded above, the following are not covered: Transmissions used in any Mustang Cobra R, Roush modified vehicles, Saleen modified vehicles, Branded vehicles, electric vehicles, compressed natural gas or propane fuel vehicles, any vehicles equipped with snow plows that are not specifically included in the Provision entitled "Covered Items - PowertrainCARE" as contained in this Agreement, and any incomplete Ford vehicles with the first three VIN positions of 1FC, 1FD (except body types E14, E24 or S24), 2FC, 2FD, 3FC, 3FD and 3FE.
Z) While We will pay for the costs of teardown, inspection and diagnosis for all covered Failures under this Agreement; We will not, however, pay for any teardown, inspection or diagnosis charges for Failures that are not covered by this Agreement.
9. REPAIR INFORMATION
9A. WHERE TO GO FOR REPAIRS: As the seller of your Agreement, the Selling Dealer is interested in your satisfaction. For the performance of covered repairs or services, it is recommended that you return to the Selling Dealer. If this is not possible, you may go to any other Ford or Lincoln-Mercury franchised dealership in the United States or Canada for repairs. If you require assistance in receiving covered repairs or services, or in locating the nearest Ford or Lincoln-Mercury dealership, if the Vehicle is a Ford or Mercury, You should contact the Ford Customer Relations Center at 800-392-FORD. If the Vehicle is a Lincoln, You should call 800-521-4140.
If the Vehicle is a Competitive-Make vehicle, a Ford or Lincoln-Mercury dealership must be used for covered repairs or services unless the Selling Dealer, or We, have authorized your referral to another dealership or repair facility.
If the Vehicle should need Emergency Service or Repair (that is, if the Vehicle is inoperable and all local Ford and Lincoln-Mercury dealership service departments are closed), other repair or service facilities may be used.
9B. REPAIRS & MAINTENANCE SERVICES ARE TO BE MADE WITH AUTHORIZED NEW, OR REMANUFACTURED PARTS: All repairs and covered maintenance services (other than for tire benefits as described in the Road Hazard Tire Coverage Provisions) MUST be made with Ford authorized new or remanufactured parts, or other products authorized by Us.
9C. LOSS LIMITS: This limitation is effective for the following coverages:
NEW PLAN - CORE Coverages - Fleet and non-Fleet (Including Competitive-Make vehicles); F650/750 Coverages; and Limo Coverages: Service contract repairs per Eligible Repair Visit will be paid up to the retail value of the Vehicle at the time of the repair, as determined by the "National Auto Dealers' Association (N.A.D.A.) Guide" for your geographic area.
NEW PLAN - Alternative Fuel (Compressed Natural Gas / Liquid Propane Gas) Coverages: Service contract repairs per Eligible Repair Visit will be paid up to five thousand dollars ($5000.00).
USED PLAN - CORE Coverages (Including Competitive-Make vehicles): Service contract repairs per Eligible Repair Visit will be paid up to the then current wholesale retail value of the Vehicle at the time of the repair, as determined by the "National Auto Dealers' Association (N.A.D.A.) Guide" for your geographic area.
USED PLAN - Electric VehicleCARE Coverages: Service contract repairs per Eligible Repair Visit will be paid up to seven thousand dollars ($7000.00).
USED PLAN - Ford or Motorcraft Remanufactured Gasoline Engine Coverages: Service contract repairs per Eligible Repair Visit will be paid up to four thousand dollars ($4000.00).
USED PLAN - Ford or Motorcraft Remanufactured Transmission Coverages: Service contract repairs per Eligible Repair Visit will be paid up to four thousand dollars ($4000.00).
10. YOUR RESPONSIBILITIES FOR CARE OF THE VEHICLE: The Vehicle must be both:
a) properly operated, and
b) maintained in accordance with the required and recommended maintenance schedules in the Service Guide of the Owner's Manual for the Vehicle, or as recommended in other documents supplied by the Vehicle's manufacturer.
Proof of proper maintenance may be required before the Vehicle will be qualified for otherwise covered repairs or services. Maintenance records consist of documents that include mileage, date of maintenance service, vehicle identification number (VIN) and what maintenance was performed. If You perform your own maintenance, receipts of purchases of maintenance items must be kept.
11. INELIGIBLE OR EXCESS COVERAGE: Any charge which You have paid for ineligible coverage or coverage in excess of the maximum allowed under this Agreement, will be refunded to You, or if your Agreement was financed, to your lienholder for credit to your account. You will be notified of the refund and the termination of any ineligible or excess coverage. We shall be liable for any valid claims arising before such refund and notification to You.
12. CONTRACT MODIFICATIONS & CHANGES: Provided your coverage under this Agreement has not expired or been otherwise limited, it may be modified or changed by You, as shown below:
NEW PLAN:
a) during the first 3 years from the Warranty Start Date (2 years for F650 & F750, 4 years for Lincoln vehicles) or within the first 36,000 miles from Zero Miles (within the first 50,000 miles for Lincoln Vehicles), whichever limitation, time or mileage, occurs first; OR
b) within the first ninety (90) days following the Signature Date, whichever limitation period ("a" or "b") is greater; AND,
c) a surcharge will apply for any coverage changes made after twelve (12) months from the Warranty Start Date, or twelve thousand (12,000) miles from Zero Miles, whichever limitation occurs first; and for
USED PLAN:
within the first ninety (90) days following the Signature Date.

12A. TRANSFERABILITY: This benefit is available for all coverages, including:
NEW PLAN - Ford and Competitive-Make CORE Coverages (Including Fleet Coverages); RentalCARE Coverages; F650/750 Coverages; Alternative Fuel (Compressed Natural Gas / Liquid Propane Gas) Coverages; and Limo Coverages
USED PLAN - Ford and Competitive-Make CORE Coverages, Electric VehicleCARE Coverages, Ford or Motorcraft Remanufactured Gasoline Engine Coverages; and Ford or Motorcraft Remanufactured Transmission Coverages
To transfer the remaining coverage under this Agreement, You or the new Agreement owner must send the following items to Us at our address as listed above:
a) a letter, signed by You, transferring this Agreement to the new Agreement holder;
b) a true statement of the present mileage on the Vehicle (or Vehicles for Fleets);
c) the name and address of the new Agreement owner; and,
d) a check to Us for the forty dollar ($40) transfer fee per Vehicle.
NOTE: (a) If the Vehicle becomes Branded during the term of this Agreement, coverage may not be transferred; and,
(b) if the Vehicle has been repossessed, this Agreement may not be available for transfer.
13. YOUR AND OUR RIGHTS TO VOID OR CANCEL THIS AGREEMENT & RELATED REFUNDS:
13A. YOUR RIGHT TO VOID THIS AGREEMENT & RELATED REFUNDS: WITHIN THE FIRST 60 DAYS FROM THE AGREEMENT'S SIGNATURE DATE: If a cancellation request is received by the Selling Dealer or Us within sixty (60) days following the Signature Date, this Agreement shall be void from its inception and the full purchase price will be refunded less any claims paid under this Agreement.
NOTE: The right to void this Agreement is not transferable and applies only to the original holder.
13B. YOUR RIGHT TO CANCEL THIS AGREEMENT & RELATED REFUNDS: AFTER THE FIRST 60 DAYS FROM THE AGREEMENT'S SIGNATURE DATE: If Your cancellation request is received more than sixty (60) days from the Signature Date, the Selling Dealer or We will terminate this Agreement and We will make a refund on a Pro Rata basis.
Your refund will be prorated under either the time or mileage limitations, whichever is the greater usage.
All cancellation requests must be submitted in writing by You to the selling dealer or to Us. If the selling dealer is no longer in business, then You may submit a written request to Us at our address as shown above. A copy of your Application form and an odometer reading statement (that is, a true statement of the Vehicle's current mileage) must be included with your request for cancellation. Your refund will be based on the purchase price You paid for this Agreement. Options purchased under this Agreement may not be cancelled independently of a cancellation of the entire Agreement.
13C. OUR RIGHT TO CANCEL THIS AGREEMENT & RELATED REFUNDS:
WITHIN THE FIRST 60 DAYS FROM THE AGREEMENT'S SIGNATURE DATE: We may cancel this Agreement within the first sixty (60) days from the Agreement's Signature Date with the refund of the full purchase price.
AFTER 60 DAYS FROM THE AGREEMENT'S SIGNATURE DATE: After the first sixty (60) days from the Agreement's Signature Date, We may cancel this Agreement only for the following reasons:
a) nonpayment of the service contract fee (in which case We must provide you notice of cancellation by certified mail);
b) a material misrepresentation to Us by You at the time of sale;
c) your failure to maintain the vehicle as prescribed by the manufacturer;
d) your failure to repair a tampered or disabled odometer on the vehicle.
If We cancel this Agreement, we will make a refund of not less than one hundred percent (100%) of the unearned gross amount that You paid for this Agreement (equally pro rated basis) and We will not charge any processing fee.
14. EXPIRATIONS & RELATED REFUNDS: If this Agreement has expired under either the time, mileage or loss limit limitations, it is not eligible for any refund.
15. WHO GETS REFUND PAYMENTS: When refunds are available, they will be paid either to You, or if your Agreement was financed, to your lienholder for credit to your account. If the amount of your refund exceeds the amount you owe, the excess will be refunded to you. Refund payments will be made by your lienholder or by Us.
NOTE: Refunds will be based on the price You paid for this Agreement as noted above. No refund will be made if this Agreement was provided at no charge to You.
16. DISPUTE RESOLUTION & ARBITRATION - Either You or We (as "Parties" to this Agreement) may choose at any time, to have any Claim decided by arbitration. The arbitration may only proceed on an individual basis, and may not be consolidated with other arbitrations or accorded any class action status. Either Party must contact the National Arbitration Forum, at 1-800-474-2371, or at
www.arb-forum.com to start an arbitration. The applicable rules (the "Rules") may be obtained from the National Arbitration Forum. If there is a conflict between the Rules and this Agreement, this Agreement shall govern.
This Agreement is subject to the Federal Arbitration Act (9 U.S.C. section 1 et. Seq) and the arbitration decision shall be in writing with a supporting opinion. You may employ an attorney to represent You in the Arbitration, but an attorney is not required.
We will pay your total reasonable arbitration fees and expenses in excess of one hundred twenty five dollars ($125). Except where applicable law provides otherwise, We will not pay your attorney fees if you should decide to use an attorney. We will pay the whole filing fee if we demand the arbitration first.
17. STATE SPECIFIC PROVISIONS - MAINTENANCE PLAN COVERAGES (FLORIDA)
17A. REQUIRED NOTICE TO FLORIDA AGREEMENT PURCHASERS: In Florida this Agreement may consist of two separate coverage plans, depending on what coverages You have elected. These coverage plans are a Motor Vehicle Service Agreement (that generally covers Vehicle failures due to materials or workmanship) and a Maintenance Plan (that generally covers routine maintenance services and wear items on the Vehicle).
Maintenance Plan Coverages are not regulated by the Florida Office of Insurance Regulation. The Maintenance Plan coverages offered under this Agreement may only be purchased in conjunction with the purchase of a Motor Vehicle Service Agreement, but such Maintenance Plan coverage is not required. The purchase of all Maintenance Plan Coverages is strictly at your option.
17B. DEFINITIONS: As used in this Agreement, the following terms shall have the following meaning:
a) Eligible Maintenance Visit - A single visit to a dealer or other service provider for the performance of a covered maintenance service or services on the Vehicle.
17C. COVERED ITEMS - "MAINTENANCE & WEAR" (AN INTEGRATED SERVICE CONTRACT and MAINTENANCE PLAN COVERAGE) - As a fleet coverage purchaser, in addition to the service contract coverages You have elected, the following Maintenance and Wear benefits is included in your Agreement:
i) Scheduled Maintenance Services - all scheduled maintenance services as listed in the Service Guide of the Owner's Manual applicable to the Vehicle(s). The most common services are listed below:

-- Engine Oil Change Every 5000 Miles Every 3000 Miles
-- Oil Filter Replacement Every 5000 Miles Every 3000 Miles
-- Tire Rotation Every 5000 Miles Every 6000 Miles
ii) Wear Items - All brake pads and linings, clutch disc, spark plugs, engine belts and hoses, wiper blades and shock absorbers, which will be replaced only if required due to wear.
NOTE: Only the items or Vehicle failure coverages listed in "i" or "ii" above are covered under this benefit.
17D. WHAT IS NOT INCLUDED UNDER THE MAINTENANCE PLAN COVERAGES -
Maintenance & Wear Plan:
a) ALL ITEMS NOT SPECIFICALLY LISTED IN THE COVERED ITEMS LIST ABOVE.
b) Services covered by any warranty or manufacturer recalls.
c) Loss of use of the Vehicle, loss of time, inconvenience, commercial loss, consequential damages, and personal expenses such as motels, food, gas and mileage (other than is provided under the Roadside Assistance benefit).
d) MAINTENANCE & WEAR ITEMS - The following items are excluded from all coverages under this Agreement: battery and cables, brakes (front hub, drums, shoes, disc rotors), coolant, exhaust systems, catalytic converters, filters, fluids, lubricants, lights (bulbs, sealed beam, lenses), squeaks and rattles, tires, tune-ups, wheel balancing, wheel alignment, and wheel studs.
17E. REPAIR INFORMATION AND WHERE TO GO FOR REPAIRS: As the seller of your Agreement, the Selling Dealer is interested in your satisfaction. For the performance of covered repairs or services, it is recommended that you return to the Selling Dealer. If this is not possible, you may go to any other Ford or Lincoln-Mercury franchised dealership in the United States or Canada for repairs. If you require assistance in receiving covered repairs or services, or in locating the nearest Ford or Lincoln-Mercury dealership, if the Vehicle is a Ford or Mercury, You should contact the Ford Customer Relations Center at 800-392-FORD. If the Vehicle is a Lincoln, You should call 800-521-4140.
If the Vehicle is a Competitive-Make vehicle, a Ford or Lincoln-Mercury dealership must be used for covered repairs or services unless the servicing dealership, or We, have authorized your referral to another dealership or repair facility.
If the Vehicle should need Emergency Service or Repair (that is, if the Vehicle is inoperable and all local Ford and Lincoln-Mercury dealership service departments are closed), other repair or service facilities may be used.
17F. REPAIRS & MAINTENANCE SERVICES ARE TO BE MADE WITH AUTHORIZED NEW, OR REMANUFACTURED PARTS: All repairs and covered maintenance services (other than for tire benefits as described in the Road Hazard Tire Coverage Provisions) MUST be made with Ford authorized new or remanufactured parts, or other products authorized by Us.
7C. TOWING REIMBURSEMENT: This benefit is available only with the
following coverages:
NEW PLAN - CORE Coverages - Fleet and non-Fleet; F650/750 Coverages; and
Limo Coverages;
If a covered failure occurs, or covered services are required, and towing
becomes necessary, towing costs will be covered up to one hundred dollars
($100) per incident, for towing to the Selling Dealer or other franchised
dealer.
NEW PLAN - Alternative Fuel (Compressed Natural Gas / Liquid Propane Gas )
Coverages:
If a covered failure occurs or covered services are required, and towing
becomes necessary, towing costs will be covered up to fifty dollars ($50)
per incident, to the Selling Dealer or other franchised dealer.
USED PLAN - CORE Coverages; and Electric VehicleCARE Coverages:
If a covered failure occurs, or covered services are required, and towing
becomes necessary, towing costs will be covered up to one hundred dollars
($100) per incident, for towing to the Selling Dealer or other franchised
dealer.
NOTE: All towing reimbursement benefits provided under this Agreement,
other than for the Alternative Fuel Coverages are administered by Ford Auto
Club.
7D. RENTAL TRANSPORTATION ASSISTANCE: This benefit is available
only for the following coverages:
NEW PLAN - CORE Coverages - Fleet and non-Fleet (Including Competitive-Make
vehicles); and,
USED PLAN - CORE Coverages (Including Competitive-Make vehicles); and
Electric VehicleCARE Coverages:
Rental transportation assistance applies only after the servicing or
repairing facility determines that the following eligibility requirements
have been met:
a) the service or repair is covered under either this Agreement
or a New Vehicle Limited Warranty; or,
b) the service or repair is the result of a Ford Motor Company
manufacturer's recall or other Customer Satisfaction program, involving a
service or repair that would otherwise be covered by this Agreement; and,
in either of these situations,
c) the covered vehicle must be kept overnight by the repairing
facility: i) because it was determined to be inoperable at the time it
was left for service, or ii) because it was determined that further
operation of the Vehicle would damage it so as to render it inoperable.
However, if You have purchased the First Day Rental Option, overnight
retention by the repairing or servicing facility is not required.
Reimbursement will be made for vehicle rental charges incurred, up to a
maximum of twenty eight dollars ($28) per day for Ford, Mercury and all
Competitive-Make vehicles (thirty five dollars ($35) per day for Lincoln
vehicles), limited to a maximum duration of ten (10) days while the repair
is being completed. Provided that the eligibility requirements have been
met, Rental Transportation Assistance begins when the Vehicle is delivered
to the Selling Dealer or other franchised dealer for service. Each eligible
day is defined as the next ensuing twenty-four (24) hour period thereafter.
The rental vehicle must be rented from a Ford or Lincoln-Mercury dealership
or other commercial agency to be eligible for reimbursement.
7E. FIRST DAY RENTAL OPTION (INCLUDING TRANSPORTATION DROP-OFF FOR
FLEETS): This option is available only for the following coverages:
NEW PLAN - all CORE Coverages - Fleet and non-Fleet (but excluding
Competitive-Make vehicles):
If your coverages allow for the First Day Rental Option (including
Transportation Drop-Off for fleets), and You have elected this option, then
this Agreement provides Rental Transportation Assistance for repairs or
services made under any of the circumstances listed in the Provision above,
even when Your vehicle does not have to be kept overnight for the repair or
services to be made. Under this option, the Rental Transportation
Assistance begins when You deliver the Vehicle to the Selling Dealer, or
other franchised dealer, or other repairing or servicing facility for
service. Each eligible day is defined as the next ensuing twenty-four (24)
hour period thereafter.
8. WHAT IS NOT COVERED BY THIS AGREEMENT -
NEW PLAN - CORE Coverages (including all Fleet Coverages), F650/750
Coverages; Alternative Fuel (Compressed Natural Gas / Liquid Propane Gas
Coverages); Limo Coverages; and,
USED PLANS - Including all CORE Coverages; Electric VehicleCARE Coverages;
Ford or Motorcraft Remanufactured Gasoline Engine Coverages; and Ford or
Motorcraft Remanufactured Transmission Coverages:
a) ALL ITEMS NOT SPECIFICALLY LISTED IN THE COVERED ITEMS LIST
ABOVE.
b) Repairs covered by any warranty or manufacturer recalls.
